SkyCalm Terms & Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the SkyCalm mobile application (the "App") operated by SkyCalm ("us", "we", or "our"). Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

Use of the App

SkyCalm grants you a limited, non-exclusive, non-transferable, revocable license to use the App strictly in accordance with these Terms.

• You must not use the App in any way that causes, or may cause, damage to the App or impairment of the availability or accessibility of the App.
• You must not use the App in any way that is unlawful, illegal, fraudulent, or harmful.
• You must not use the App to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

Medical Disclaimer

SkyCalm is designed to provide informational and educational content related to flight anxiety and calming techniques. The App is not intended to replace professional medical advice, diagnosis, or treatment.

• The content in the App, including breathing exercises, calming techniques, and informational resources, is for general information purposes only.
• The App is not a substitute for professional medical advice, psychiatric advice, diagnosis, or treatment.
• If you are experiencing severe anxiety, panic attacks, or any mental health concerns, please consult with a qualified healthcare provider.
• SkyCalm is not responsible for any actions taken as a result of information provided in the App.

Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of SkyCalm and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SkyCalm.

User Content

Our App allows you to create and store content, such as journal entries and personal notes ("User Content"). You retain all rights to your User Content, and you are responsible for your User Content.

By using the App and entering User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, copy, and display your User Content in connection with providing the App services to you. This license exists only as long as you maintain your User Content on the App and will terminate when you delete your User Content or your account.

Account Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

Limitation of Liability

In no event shall SkyCalm, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the App;
• Any conduct or content of any third party on the App;
• Any content obtained from the App; and
• Unauthorized access, use or alteration of your transmissions or content.

Indemnification

You agree to defend, indemnify and hold harmless SkyCalm and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, or b) a breach of these Terms.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
